These terms are here to make sure both of us are on the same page and to keep the process smooth and enjoyable.

☆ The commissioner (referred as "you") is expected to read through my Terms of Service(referred as "TOS") before requesting a commission. The commissioner understands that by violating these TOS their commission will be cancelled immediately.☆ Unless we both agree otherwise, all commissions are for PERSONAL USE only.Commercial licenses are available at any time if you’d like to use the artwork for publishing, promotion, or anything involving profit.☆ As the artist, I keep the rights to all my work. This means I may use the finished piece for my portfolio, website, or social media, unless we agree to keep it private.☆ If your project is meant to be released on a specific date (like a book reveal), let me know. I won’t share the artwork publicly before that agreed date. If 12 months pass without your release and we don't have an approximate agreed date, I might share it in my portfolio or on social media.☆ Please remember to credit me as Xulimoy / @xulimoy whenever you share or display the artwork.☆ Every piece will include a small, subtle watermark/signature that should not be removed (unless discussed for commercial work).☆ Clients must review carefully; the Artist is not liable for errors after approval.☆ Check my previous pieces to see if you want a certain style or aesthetic I've done before.☆ References of hair, faces, expressions, poses, colors, clothing, etc. must be included in the registration form or email.☆ All commissions include a simple color background, the client can specify any preferences over this.☆ Do NOT mint/sell the art for NFT.☆ NO AI USE: Artwork is fully original and handmade. The Client may not use it in AI tools, training, or datasets. Violation ends the license immediately with no refund.☆ I have the right to reject any order that I do not feel comfortable.☆ Prices are subject to change at any time without notice, based on demand, but never during the middle of a commission.

PROCESS

Updates will be sent at the end of every phase. If needed, feel free to draw over any material I send during these check-ups to better illustrate your ideas.

Sketch stage:

You’ll get either one or several sketch options to choose from, and in this stage you have several revisions. However, if you’d like bigger changes after approving the sketch, or if the request is essentially a new idea, there may be an additional fee.

Color stage:

Once the sketch is approved, I’ll move to the coloring stage. You can request up to 5 small adjustments, such as color tweaks or tiny details. Any significant changes at this point may incur an additional cost.

Final touches & delivery the artwork:

Only small adjustments are included, such as refining shading or highlights. Major changes like altering the background or redesigning elements will be charged separately.

Once you’ve approved the final artwork, any further big changes will count as a new commission, unless it’s to correct a mistake on my side.

DELIVERY

☆ While I'm working on your commission I will make reviews with you to make sure I make it just right for you!☆ The time it takes to finish your commission varies from 2 weeks to 2 months depending on factors such as the complexity of the commissioned piece, other work, etc.If anything comes up that will slow the progress of the initially estimated delivery time I will let you know as soon as possible.☆ Please tell me beforehand if you have a specific deadline! I will charge extra for rushed commissions.☆ Final files will be delivered in JPEG, PNG, or PDF format (source files are not included). If you need layered files for video editing or other uses, please let me know in advance so we can discuss it.☆ This image with the watermark is the one that you can post freely on social media.NOTE: This is a digital file only, NOT a physical product.

IMPORTANT

Please respond to the feedback or review within 10 days, or let me know in advance if you need more time. If I don't hear back, the project may be paused until a new timeframe is agreed upon.

Clients must review carefully; the Artist is not liable for errors after approval.

☆ Payment is done through a PayPal invoice, using euros (€) as the currency.☆ Commissions can be paid either 100% upfront or split 50% upfront and 50% after the finished piece approval. We can also discuss other payment plans to better fit your needs.☆ For private commissions within the EU, a 21% VAT (IVA in Spain) will be added. If you’re a registered business with a valid VIES number, VAT won’t apply.☆ For invoicing and tax purposes, I’ll need to collect some basic personal information (full name, address, and some type of ID number). It’s required for billing on my end, and it will only be used for these purposes and handled securely through our contract.☆ All personal and payment information stays confidential.

☆ Personal use means you can share the artwork with friends and family, post it a few times on your social media, use it as an avatar or wallpaper, or even print it for yourself or display it at home.☆ What you cannot do is use it to make money (e.g. merch, ads, publishing) or claim the artwork as your own.☆ You’ll receive the artwork as a high-resolution digital file in PNG, JPEG and PDF (no physical products).

☆If you’d like to use the artwork professionally (e.g. in books, promotional material, merchandise, or any project where it generates profit), a commercial license is required.☆ The rights granted will be clearly outlined before starting. All rights not explicitly granted in the contract remain with me, the Artist.☆ Usage rights only begin once full payment is received. Additional uses not covered in the license can always be negotiated later for a fee.☆ Non-exclusive and promotional licenses allow me to reuse or resell the artwork if I choose. If you’d like an exclusive license, let me know and we can discuss terms.☆ Credit: Required whenever possible on digital media, and always on printed media.☆ Final files will be delivered in JPEG, PNG, or PDF format (source files are not included). If you need layered files for video editing or other uses, please let me know in advance so we can discuss it.☆ Once the license expires, the Client must stop distribution and remove remaining copies.☆ Licensing is non-transferable. You may not sell, resell, or sublicense the artwork to third parties, any external usage rights remain exclusively with me.

Before Work Starts:

If you cancel before I’ve begun, no payment is required and the project is simply closed.

During Sketch Stage:

If you cancel after sketches have been delivered, you agree to pay 50% of the total project fee to cover time and resources already invested. The sketches remain the Artist's property, and you do not have the right to use or retain them.

After Final Artwork Delivery:

If you cancel once the finished illustration has been sent (whether you approve it or not), you agree to pay 100% of the fee. At this stage, the work is complete, and all rights remain with the Artist.

Rejection:

If you reject the artwork (decide not to use it) within 7 days of receiving the final piece, it is treated the same as a cancellation. You must still pay according to the stage of completion (50% or 100%). You will have no rights to use the rejected artwork in any way.

Refunds:

Once I have started work, refunds are not available. The only exception is if I personally cancel the project before delivering anything, in that case, you will be fully refunded.

Commercial License Adjustment:

If the Client receives the final artwork but chooses not to use it commercially, the commercial license fee may be reduced or removed. In that case, the Client pays only for personal use, and all commercial rights remain with the Artist. If the full commercial fee has already been paid, the difference may be credited as credit toward future work, at the Artist’s discretion.

I, Júlia Moyano, xulimoy (the artist); claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:· I reserve the right to cancel and refund the order at any time for any reason.· I retain all copyrights over the commissioned artwork.· I will NOT claim the intellectual property (IP) of the commissioned artwork.· I reserve the right to post the commissioned artwork via social online networks, in my portfolio, for sale in art shows/galleries/conventions, as well as in publications such as art books unless agreed otherwise.The buyer is allowed to:· You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, making prints for any use aside from personal, etc.) unless a commercial license is purchased.· Print the artwork and claim the character(s) as their own, but not the artwork itself.· You retain the rights to the intellectual property (IP).· You may NOT use my artwork in any Artificial Intelligence (AI) software generators.The following is considered copyright infringement:· Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.· Claiming the artwork as your own.· Altering the artwork in any form without my consent. For example, removing my signature from the artwork.I reserve the full rights to the image and its use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time).

Between late 2024 and early 2025, I developed several concepts for a Viking character for a video game company based in Barcelona. The project was eventually canceled, but the test served as a strong character design and visual exploration exercise.
